1. Acceptance of Terms

By accessing or using TullyType ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

TullyType is a browser-based typing practice tool that provides:

• Typing practice with sample and custom documents
• Real-time statistics tracking (WPM, accuracy, key analysis)
• Peer-to-peer multiplayer typing races
• Optional Pro subscription with additional features

3. User Eligibility

You must be at least 13 years old to use TullyType. If you are under 18, you must have parental or guardian consent to use the Service and purchase Pro subscriptions.

4. Free and Pro Subscriptions

Free Users have access to:

• Unlimited typing practice with sample documents
• Joining multiplayer lobbies
• Basic statistics tracking
• Free type mode

Pro Users ($2.37/month) additionally have access to:

• Uploading custom documents in multiple formats
• Pasting custom text for instant practice
• Hosting multiplayer lobbies (up to 10 players)
• Priority support

Pro subscriptions are billed monthly and automatically renew until canceled. You may cancel at any time, and you will retain Pro access until the end of your billing period.

5. User Conduct

You agree NOT to:

• Upload or share content that is illegal, offensive, harmful, or violates others' rights
• Upload copyrighted material you do not own or have permission to use
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to distribute malware, spam, or phishing content
• Abuse multiplayer features by cheating, harassing others, or disrupting games
• Share your Pro subscription credentials with others
• Use automated tools or bots to gain unfair advantages

Violation of these rules may result in suspension or termination of your account.

6. Intellectual Property

TullyType, including its logo, design, code, and content, is owned by Tully Blake Martin and protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without permission.

Documents you upload to TullyType remain your property. By uploading content, you grant TullyType a license to temporarily process the content for typing practice purposes (stored locally on your device only).

7. Data and Privacy

TullyType stores your documents, settings, and typing statistics locally on your device using localStorage. Your data is not transmitted to our servers except when necessary for Pro subscriptions (payment processing) or multiplayer connections (peer-to-peer data only). See our Privacy Policy for details.

8. Multiplayer Disclaimer

Multiplayer mode uses peer-to-peer connections. TullyType is not responsible for:

• Connection failures or lag due to network issues
• Behavior of other players in multiplayer games
• Data transmitted between players during games

Players are expected to treat others with respect during multiplayer games.

9. Payments and Refunds

Pro subscriptions are processed through Stripe or other secure payment processors. Payments are non-refundable except as required by law or at our discretion. If you experience technical issues preventing use of Pro features, contact support for assistance.

10. Disclaimer of Warranties

TullyType is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or secure. Use at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Tully Blake Martin and TullyType shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to data loss, lost profits, or business interruption.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of TullyType at any time without notice. We may also update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your access to TullyType at any time for violation of these Terms or for any other reason at our discretion. You may also stop using the Service at any time and delete your data from your browser.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which Tully Blake Martin resides, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
